What is a foreclosure?
Foreclosure is the process by which a lender acquires a property when the property owner defaults on their mortgage. Once the lender has completed this process the property becomes part of their (REO) Real Estate Owned portfolio and they then sell the property at a greatly reduced price, to get the property off their books as fast as possible. Banks can not make money sitting on real property. If you submit an offer on a foreclosure you will deal directly with the lender. This process is generally the same as buying a home directly from the property owner.
Short Sale
What is a Short Sale?
A Short Sale is the process which allows a property owner, who is no longer able to make their mortgage payment due to some hardship, such as job loss, have the lender accept less than the actual amount they owe and the lender then sells the property at a greatly reduced price. This generally occurs when the property owner is unable to sell the property for the amount they actually owe the lender on the mortgage. Usually this is due to the property having lost value because of area market conditions. When dealing with a Short Sales the property price is generally set by the listing realtor, by making a comparative market analysis. This is usually a price the bank may or may not agree with. The offer must first be accepted by the seller and then it is presented to the lender. As in any transaction if the lender wants, they may raise the asking price and at this point you may negotiate a mutual agreed upon price. This process may take a long period of time. In these cases the Seller may be held responsible for the difference between the sale price and the amount owed to the lender. Also at any time during this process the lender may put the property into foreclosure.
